General Terms & Conditions – Charlotte & Grace Boutique
Article 1 – Definitions
In these Terms & Conditions, the following definitions apply:
Withdrawal Period – the period during which the consumer may exercise their right to cancel the agreement;
Consumer – a natural person acting outside the scope of a business or profession who enters into a distance agreement;
Day – calendar day;
Long-Term Agreement – a distance agreement relating to a series of products and/or services supplied over time;
Durable Medium – any tool that enables information to be stored in a way that allows future access and unchanged reproduction;
Right of Withdrawal – the consumer’s right to cancel the agreement within the withdrawal period;
Entrepreneur – the natural or legal person offering products and/or services remotely;
Distance Agreement – an agreement concluded without the simultaneous physical presence of both parties;
General Terms & Conditions – this document outlining the conditions of sale.

Article 3 – Applicability
These Terms & Conditions apply to every offer made by the entrepreneur and to every distance agreement concluded with a consumer.
Before the agreement is finalized, the consumer will receive these Terms & Conditions or have the opportunity to easily save and access them.
If any individual terms conflict with these Terms & Conditions, the provision most favorable to the consumer shall prevail.
Article 4 – The Offer
Each offer contains a clear and accurate description of the products or services offered.
The offer includes information regarding:
- prices excluding customs duties, VAT, or import fees;
- the fact that all orders are shipped from China;
- the fact that the online store does not act as the importer of record within the EU;
- the average delivery time of 5–10 business days;
- the withdrawal procedure, payment methods, and delivery process.
Article 5 – The Agreement
The agreement is concluded when the consumer accepts the offer and the entrepreneur confirms the order.
After placing an order, the consumer will receive confirmation electronically.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the agreement without giving any reason within 14 days of receiving the product.
Withdrawal requests must be submitted by email or in writing.
In the event of a valid withdrawal, the full purchase amount will be refunded. The product does not need to be returned — the consumer may keep it.
In the case of complaints or dissatisfaction, the entrepreneur may offer a partial refund (a percentage of the purchase amount). The consumer may either accept this proposal or exercise their full right of withdrawal.
Article 7 – Returns & Refunds
The store does not accept physical returns. Consumers are not required to return products, even in cases of cancellation or complaints.
Returns sent to the business address will not be accepted or processed.
Refunds (partial or full) will be issued within 14 business days to the original payment method used for the order.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to products that are:
- custom-made or personalized;
- opened or damaged for hygiene reasons;
- perishable or subject to a limited shelf life.
Article 9 – Prices
All prices are listed in euros and do not include VAT, customs duties, or other import charges unless explicitly stated otherwise.
Obvious pricing errors or mistakes in the offer are not binding on the entrepreneur.
Article 10 – Compliance & Warranty
Products must conform to the agreement and the product description.
The warranty does not apply in cases of:
- damage caused by the consumer;
- self-repairs or modifications;
- improper use.
Article 11 – Delivery & Fulfillment
The entrepreneur will make every reasonable effort to fulfill orders according to the agreed terms.
All shipments are sent directly from China. The entrepreneur does not maintain inventory within the EU and does not act as the importer.
The average delivery time is 5–10 business days and depends on location, customs processing, and shipping carriers.
Risk related to shipment (including delays, loss, or damage) transfers to the consumer once the package has been shipped.
Article 12 – Duration & Termination
Agreements entered into for an indefinite period may be terminated at any time with one month’s notice.
Fixed-term agreements automatically expire at the end of the agreed period.
Article 13 – Payment
Payment must be made within 7 days after placing the order unless agreed otherwise.
In the event of non-payment, the entrepreneur may charge statutory interest and collection costs.
Article 14 – Complaints
Complaints must be submitted within 7 days of receiving the product by email or in writing.
The entrepreneur will respond to complaints within 14 days.
Article 15 – Governing Law
All agreements are governed exclusively by Polish law, regardless of the consumer’s country of residence.
Article 16 – International Shipping, Customs & Taxes
All orders are shipped directly from China. Shipments are handled by an external fulfillment provider.
The store does not import goods into USA or other EU countries. The consumer is responsible for customs clearance in their own country.
The consumer is fully responsible for paying any customs duties, VAT, import taxes, or additional charges required by customs authorities or shipping carriers.
If these charges are not paid and the shipment is delayed, returned, or destroyed, the entrepreneur is not liable. In such cases, refunds will not be issued.
Any delays, customs inspections, or additional costs are entirely at the consumer’s own risk and expense.
By placing an order, the consumer confirms that they:
- have read and accepted these Terms & Conditions;
- understand that the shipment originates from China;
- accept all associated risks and costs.
